BY AND BETWEEN M/s. JF TRUST, a trust set up under the laws of India and having its principal office at No.443, MOHINI, 13th Main Road, Srinivasanagar, Bangalore 560050 represented by its Managing Trustee, Mr. K.Mangal Chand Jain, S/o. Mr. Keval Chand, hereinafter referred to as the "LICENSOR" (which expression shall whenever the context so required or admits, mean and include his heirs, executors administrator and assigns) of the ONE PART;

AND Mr.............................................., S/o. Mr. ..........................., aged about ................... years, presently residing at ......................................................... Bangalore, Karnataka, hereinafter referred to as the "LICENSEE" (Which expression shall whenever the context so requires or admits, mean and include her heirs, executors, administrators and assigns) of the OTHER PART.

WHEREAS THE LICENSOR, is the absolute and lawful owner of the premises being Flat No. ............ on ................ Floor of .....................Block of Sukhshanthi Apartment, comprising of One Bed room with attached bath, living, kitchen and one utility, hereinafter referred to as the "PREMISES" and more fully described in the Schedule hereto. THE LICENSEE being in need of residential accommodation has approached "THE LICENSOR" to permit the Licensee to use the Premises for a period from ................... upto ...............................

NOW THIS AGREEMENT WITNESSETH AND IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:

1. THE LICENSOR hereby grants to THE LICENSEE the right to reside on the Premises for a period from ................. till 31.12.2016 and THE LICENSEE hereby accepts the same.

2. THE LICENSEE has paid an amount of Rs.25,000/- (Rupees Twenty Five Thousand Only) by way of ................... towards admission fees. This admission fees is non-refundable.

3. THE LICENSEE shall pay to THE LICENSOR, the license fee of Rs. 18,150/- (RUPEES EIGHTEEN THOUSAND ONE HUNDRED AND FIFTY ONLY) ("License Fee") per month for the occupation and use of the Premises. THE LICENSEE shall pay the License Fee on or before 5th of every month in advance. In case there is delay in payment of License fee, additional amount of Rs.200/- per day will be chargeable as a penalty, till the date of payment .

4. The Licensee Fee shall be calculated for one month even if THE LICENSEE uses the Premises for a part of the month.

5. The inclusions in the Licensee Fee of Rs. 18,150/- has been more clearly defined in Annexure A.

6. The Licensor may permit the Licensee to use the Premises beyond 31.12.2016, upon such terms and conditions as are mutually settled between them and reduced in writing and on such renewal, the Licensee Fee shall be increased by 10% on the existing Licensee Fee effective from 01.01.2017.

7. THE LICENSEE has paid to THE LICENSOR a total sum of Rs.4,00,000/- (Rupees Four Lakhs Only) by way of CHEQUE / CASH, ............ as interest free security deposit. Such deposit will be refundable at the time of THE LICENSEE vacating the Premises (The refund will be made on the 90th day from the date of vacating premises) However the refund will be subject to handing over the Premises in good condition and the LICENSOR is entitled to deduct amount due to damages, if any or any dues towards payments agreed to be paid by the LICENSEE as per the terms of this Agreement.

8. In addition to the License Fee payable monthly as stipulated above, THE LICENSEE shall pay for electricity used in the Premises on actual basis as shown by a separate meter. This has been further explained in Annexure A. The actual charges of Electricity shall be paid by THE LICENSEE to the Authorities irrespective of stay at the Premises during his/her tenure.

9. At the time of vacating the premises THE LICENSEE has to pay Rs. 25,000/- (Rupees Twenty Five Thousand Only) to the Licensor as wear & tear, repairs and repainting charges.

10. THE LICENSEE HAS TO GET MASTER MEDICAL CHECKUP DONE AT HIS / HER COST BY A REPUTED HOSPITAL (APOLLO, FORTIS, RAMAKRISHNA, MEDINOVA OR EQUIVALENT BEFORE OCCUPYING THE FLAT.

THE LICENSEE HAS TO GET THE CERTIFICATE FROM A REGISTERED MEDICAL PRACTITIONER THAT HE / SHE IS MEDICALLY FIT TO OCCUPY THE PREMISES.

11. That any damage caused to the Electrical Equipment, Fittings, building will be recovered from THE LICENSEE and the decision of THE LICENSOR with regard to the amount of repair or replacement charges shall be final and binding.

12. THE LICENSOR shall have absolute authority to deduct dues for the above mentioned clause 1 to 10 during refund of the interest free security deposit if the amount is unpaid.

13. The Parties hereby agree that notwithstanding anything to the contrary contained in this Agreement, the Licensor shall be deemed to be in exclusive possession and control of the Premises.

14. THE LICENSOR HAS THE RIGHT TO SHIFT THE ACCOMMODATION TO OTHER FLAT WITHIN THE SAME PROJECT WITH A 10 DAYS NOTICE HOWEVER THE SHIFTING ARRANGEMENTS WILL BE DONE BY THE LICENSOR AT ITS OWN COST.

15. THE LICENSOR IS THE ABSOLUTE OWNER OF FLAT NO. .......... THIS FLAT WILL BE OPENED FOR SALE FOR PROSPECTIVE CUSTOMERS WHO WANT TO BUY THE FLAT. THE LICENSOR WILL GIVE A PRIOR 8 HRS NOTICE TO LICENSEE REGARDING INSPECTION OF THE "PREMISES". THE LICENSOR HEREBY AGREES TO ALLOW THE PROSPECTIVE CUSTOMER TO INSPECT THE "PREMISES". IN THE EVENT, THE PREMISES IS SOLD TO NEW CUSTOMER, THE LICENSOR WILL ACCOMMODATE THE LICENSEE IN ANOTHER FLAT IN THE SAME PROJECT WITH A 10 DAYS NOTICE. HOWEVER, THE SHIFTING WILL BE DONE BY THE LICENSOR AT ITS COST.

16. LICENSEE shall not assign, mortgage, charge, Sub-License, sub-let or otherwise transfer the Premises or any portion of it in any manner whatsoever, the License being a personal one, restricted for use or occupation of THE LICENSEE and is neither transferable nor intended to be transferable.

17. The Premises shall be used for residential purpose only and for no other purposes whatsoever. Nothing in this clause is construed as permitting any other person to use and occupy the Premises.

18. Nothing contained herein will be construed as a lease or sub-lease of the Premises or any part thereof in favour of the Licensee.

19. That all the Sanitary, Electrical and other Fittings in the Premises shall be restored by THE LICENSEE to THE LICENSOR at the time of handing over the Premises to THE LICENSOR in as good a condition as they are at present, subject to natural wear and tear and damage by the act of God.

20. That THE LICENSEE shall permit THE LICENSOR, his authorized representatives etc., to enter upon the Premises for inspection and carry out repairs etc., at reasonable time with prior advance notice as and when necessary.

21. THE LICENSEE shall use the premises with due care and caution and shall keep and maintain the same in good order and condition.

22. THE LICENSEE shall keep the interior of the premises, to keep fixtures and the fittings including electrical, sanitary and plumbing fixtures therein good and tenantable condition, subject to wear and tear.

23. THE LICENSEE shall not create any encumbrance of permanent nature such as registering ration card or giving the address of the Premises as permanent address during the period of the license.

24. THE LICENSEE shall not make any structural alterations of any kind and also not erect or build or permit to be erected or built on the Premises, any construction or to the fixtures and fittings therein. Further, the Licensee shall not store any goods which are inflammable, hazardous or combustible or considered objectionable by any authorities or dangerous or excessively heavy which may affect or damage the construction or structure of the building.

25. THE LICENSEE confirms and agrees that PETS are not allowed inside the Premises or the building of which the Premises is a part of.

26. THE LICENSEE shall not do any act or deed which may cause nuisance, annoyance, to THE LICENSOR or the occupants of other premises in the building where in the Premises is situated.

THE LICENSEE shall maintain dignity and decorum and shall not create any disturbances to neighbors & management, THE LICENSOR shall have absolute authority in evicting THE LICENSEE by giving 30 days notice if dignity and decorum is not maintained.

28. THE LICENSOR shall not be responsible or liable for any theft, loss, damage or destruction of any property of THE LICENSEE or of any other person lying in the Premises nor for any bodily injury or harm to any person in the Premises from any cause whatsoever.

29. THE LICENSEE is not eligible to attend meetings of the Society nor do they have any rights in functioning or decision making of the society.

30. THE LICENSOR shall as member of the society of occupants/owners at Sukhshanti apartments duly observe and comply with all the rules, Regulation and bye-laws of the society and THE LICENSEE shall abide by the decisions and comply with such rules, regulations and bye-laws.

31. The License hereby granted is for the licensee and the licensee shall not assign transfer or permit any other person or party to occupy the Premises or any portion thereof to any person or party.

32. THE LICENSEE shall not at any time put claim of tenancy or sub-tenancy or any other right or title in to or in respect of the Licensed premises under any law presently in force and any laws which may be enacted hereafter and this agreement shall not be constructed to create any such right whatsoever in favor of THE LICENSOR.

33. THE LICENSEE shall comply with the regulations set out in Annexure A hereto while in occupation of the Premises.

34. THE LICENSEE shall have the right to use and enjoy without any restrictions whatsoever the entrances, staircase, landings, corridors, lift roads and passage in and outside the aforesaid premise so far as the same are necessary for the enjoyment of the same.

35. THE LICENSEE shall vacate the Premises to THE LICENSOR on expiry or earlier termination of this agreement of this license, reasonable wear and tear accepted.

36. At the time of THE LICENSEE vacating the Premises, THE LICENSEE shall be entitled to remove all items of furniture & fixed furniture, fixtures and fitting belonging to them and brought into the Premises from time to time. The security deposit as provided in clause NO.6 herein above will be returned to THE LICENSEE on the vacating the Premises to THE LICENSOR /or earlier determination.

37. The permission granted to the Licensor to use the Premises for residence shall automatically terminate on the termination of the lease with respect to the Premises granted to the Licensor.

38. Right of termination. THE LICENSOR has the right to terminate this agreement notwithstanding anything contained in the agreement by giving two months advance notice in writing.

In the event the LICENSEE intends to terminate this Agreement, the Licensee is required to give two month's notice in writing or in lieu of notice, make payment of two months rent aggregating to Rs.36,300 /- (Rupees. Thirty Six Thousand Three Hundred Only).

39. In medical emergencies the LICENSEE will be admitted in, TIRUMALA HOSPITAL and all expenses will be re -reimbursed by the LICENSEE. Or the amounts will be deducted from the deposit.

40. In medical emergencies of members of Licensee, LICENSEE must accompany the patient to the hospital. LICENSOR will give all help only.

41. In case LICENSEE himself is in need of medical assistance, members living with the LICENSEE should accompany the LICENSEE to the hospital.

42. In case LICENSEE is staying alone, all help will be provided by the LICENSOR but LICENSEE must pay for all expenses.

43. The LICENSEE must give the details of NOK (Next of Kin) who are to be informed in case of medical emergencies.

44. In case the LICENSEE does not have any NOK (Next of Kin) he should give in writing the course of action to be taken in medical emergencies and course of action subsequently.

45. This agreement shall be subject to the exclusive jurisdiction of the courts in the city of Bangalore only.

46. All the letters notices and other communications to be served upon THE LICENSEE or licensor after the commencement of this License shall be deemed to be effectively served if same is sent by registered post / speed post and addressed on the address given herein above.

The premises situated at Flat No. .......... in the SUNFLOWER BLOCK of the SUKHSHANTHI Apartment located in Survey No. 284/1, Belathur Village, Hosur Taluk, Krishnagiri District. Tamil Nadu.

Guest & Visitors are permitted only during 9:00 AM to 6:00 PM e. The services of guest room & Club Facilities can be availed on payment of the applicable charges subject to availability. f. NON VEG FOOD AND ALCOHOL ARE NOT PERMITTED INSIDE THE CLUB PREMISES. g. The LICENSEE has to follow the security guidelines issued by the company from time to time h. Sweeping the flat and cleaning toilet will be on alternate days. i. Bed linen will be changed once a week. IN WITNESS WHEREOF the parties have put their hands hereunto the day and first hereinabove written.
